Probably the easiest way to answer that question is to see if your suspected lemon automobile follows these two primary criteria: Was the car, truck or RV bought (or leased) in the State of Florida? Was it new when you bought it? If you answered no to either of these questions than fighting for protection under Florida's Lemon Laws probably isn't right for you.*
If you answered yes, then you just need to check and make sure your defective auto isn't excluded. Though Consumer Rights are protected under Florida Law, and with the right attorney fighting for them your chances of successfully recouping your investment increases, there are still some situations that you might not have any recourse.
Some of these exclusions to the Lemon Law are as follows:
- Motorcycles
- Mopeds & similar type vehicles
- Vehicles bought for the purpose of resale
- Off-road vehicles
- Trucks weighing more than 10,000 lbs (gross vehicle weight)
- The "Living Facilities" of R.V.s (recreational vehicles)**
